You already know that an arrest is a serious matter. What you may not realize is that an arrest or criminal charge is nothing more that an accusation based on probable cause. The key word is "probable". Probable cause is a relatively low standard of proof.
To convict you of the charge the Government or State Prosecutor must be able to prove every element of the accusation or charge "beyond and to the exclusion of a reasonable doubt" via the use of "admissible evidence" This is a much higher standard of proof.
Simply put, each case is different. There may be defenses available to you due to the facts of your unique case. In addition, the Government may have made constitutional or procedural errors in your case that could lead to a reduction of charges, or reduction of penalties,
or even a dismissal of the charges against you.
You should also be aware, that certain charges like DUI, also carry a risk that the DMV will suspend your license. This is an administrative proceeding separate from the Court. If the DMV has suspended your license due to a DUI arrest, you only have 10 days to request an administrative hearing to challenge the suspension or you will waive your right to that hearing.
